Power Moves
Joyce looks directly at the bench. “We respectfully request the petition be denied in full, and that the court consider whether this filing rises to the level of bad faith.”
The judge leans back in her chair, folds her hands, and looks at Kelly Powell. “Ms. Powell.”
Kelly straightens. “Yes, Your Honor?”
The judge’s tone is even—but unmistakably irritated. “I have reviewed the pleadings. I’ve listened to argument. I’ve reviewed the exhibits. And I want to be very clear.” She pauses. “This case should never have been filed.”
Kelly blinks. Michelle stiffens.
“There is not a single factual allegation in this petition that meets the statutory standard for modification. Not one. What is evident is a personal grievance attempting to masquerade as a child welfare issue.”
The judge turns her attention fully to Michelle. “Mrs. Adams-Porter, the court is not a tool to manage your feelings about your former spouse’s life choices.”
Michelle opens her mouth.
The judge raises a hand. “You do not get to dictate who the other legal parent allows around the child absent proof of harm. Discomfort is not harm. Jealousy is not harm. Speculation is not harm.”
She looks back at Kelly. “And counsel, I expect attorneys practicing in this courtroom to understand that distinction before filing motions that force the court to waste time and resources.”
Kelly swallows. “Understood, Your Honor.”
The judge picks up her pen. “The petition for modification of custody and visitation is denied in its entirety.” She signs.
“Furthermore,” the judge continues, “the court finds this action borders on frivolous. I am reserving jurisdiction on the issue of sanctions should this conduct continue.”
Michelle’s breath catches.
The judge fixes her with a final, unwavering look. “If you continue to interfere with the respondent’s custodial rights without lawful cause, you will find yourself on the wrong side of a very different order.”
The judge turns to the clerk. “Next case.”
Joyce rises smoothly. “Your Honor, one final matter before we conclude.”
The judge pauses, already displeased, but nods. “Briefly, Ms. Wischnia.”
Joyce turns slightly toward the bench, hands folded. “Pursuant to Family Code Section 271 and Code of Civil Procedure Section 128.7, the respondent respectfully moves for an order awarding attorney’s fees and court costs incurred in defending this action.”

And that is what Bette already warned you about Michelle if you were foolish enough to go through with this and bring this to court.
You lost everything and it’s your own fault.
Love how Bette & Tina entered the courtroom, hands linked together, fully in support of each other. The support from their friends and especially Kit who supported Tina. Don’t feel guilty anymore Tina, Bette forgave you, it’s time to move forward and i like Bette’s idea to sell the house and look for a new home together.
I love this story, hope to read a new chapter soon.
Happy to see new chapter. Thanks for that.
So happy that you posted another chapter of this great story. Beautifully written as always! Please continue.
Oh my! I was on the edge reading the updates. I love Bette in this version. Hope she doesn’t go soft and stick to her word. I like the other version but that Bette frustrated me how she was always talk and no bite. The Bette in the rewrite oh my – she ROCKS!!! standing on business.
