Power Moves
A murmur ripples faintly through the gallery.
Joyce continues, her voice measured and unwavering. “This petition was filed without factual or legal basis, for an improper purpose, and in direct contravention of well-established custody standards. My client was compelled to retain counsel, prepare exhibits, and appear in court solely to respond to allegations that the court has now deemed meritless.”
She pauses. “Section 271 exists to deter exactly this type of conduct—litigation pursued to harass, control, or punish the other parent rather than advance the child’s best interests.”
Kelly is on her feet instantly. “Objection, Your Honor. This motion is punitive and premature. My client brought this action in good faith—”
The judge’s hand comes down sharply on the bench. “Ms. Powell, sit down.”
Kelly freezes, then complies.
The judge’s voice is no longer patient. “Good faith requires more than asserting it after the fact. It requires reasonable investigation before invoking this court’s authority.”
She turns her attention back to Joyce. “Ms. Wischnia, does your client have documentation of fees and costs incurred?”
“Yes, Your Honor,” Joyce replies calmly. “Itemized billing statements and filing costs are prepared and ready for submission.”
The judge nods once, then looks directly at Michelle. “Mrs. Adams-Porter, listen carefully.”
Michelle’s face has gone pale.
“This court finds that your petition was frivolous, unsupported by evidence, and motivated by personal animosity rather than concern for your child’s welfare.”
Michelle’s lips part. No sound comes out.
The judge continues. “You were warned—through counsel and through statute—that baseless claims in custody matters carry consequences. You chose to proceed anyway.”
The judge turns back to Kelly. “And counsel, your obligation is not merely to advocate—it is to advise. Filing motions that lack legal merit exposes your client to sanctions, and I expect better judgment from officers of this court.”
Kelly nods stiffly. “Yes, Your Honor.”
The judge picks up her pen. “Pursuant to Family Code Section 271, the court finds that the petitioner’s conduct unreasonably frustrated settlement, increased litigation costs, and abused the judicial process.”
She writes. “The petitioner, Michelle Adams-Porter, is hereby ordered to pay the respondent’s reasonable attorney’s fees and court costs incurred in this matter.”

And that is what Bette already warned you about Michelle if you were foolish enough to go through with this and bring this to court.
You lost everything and it’s your own fault.
Love how Bette & Tina entered the courtroom, hands linked together, fully in support of each other. The support from their friends and especially Kit who supported Tina. Don’t feel guilty anymore Tina, Bette forgave you, it’s time to move forward and i like Bette’s idea to sell the house and look for a new home together.
I love this story, hope to read a new chapter soon.
Happy to see new chapter. Thanks for that.
So happy that you posted another chapter of this great story. Beautifully written as always! Please continue.
Oh my! I was on the edge reading the updates. I love Bette in this version. Hope she doesn’t go soft and stick to her word. I like the other version but that Bette frustrated me how she was always talk and no bite. The Bette in the rewrite oh my – she ROCKS!!! standing on business.
