    Chapter 3 – Lets Make a Deal

Tina:  And I got a new car also.  It’s a white gold metallic color with beige color interior.  It’s a year newer and I love it.

Kit:  Sounds beautiful and sounds like it looks like you, too.  Did you two do this all today?

Tina:  Yep, we did.  Now, how about we go in and have some tea?

Kit:  Yes, please come in.  I’ll put the tea pot on.

Tina saw the stack of envelopes on the table all addressed to her and Bette.  Bette had gone into the kitchen to help Kit, so Tina started opening the packages to inspect the contents. If there was a problem, she wanted to get on it right away.

Kit:  Tina, your mail is on the coffee table. Help yourself.

    Bette:  Kit are you alright?

Kit:  I don’t know. I have been reading all afternoon the will and some of the trust.

They prepared the tea and brought the tray with the bags, cups, and hot water.  Tina and Bette selected a green tea and Kit selected an Earl Grey.

Kit:  As I was saying, I am not well versed in reading legalese.  The will never mentions Paris by name but there are places where it refers to all my children or descendants – natural and adopted.  And I presume that adopted means adopted through a judicial procedure like the way you adopted Angie and Daniel.

Bette: Do you think Daddy adopted any children?

Kit:  Not that I know of.  Of course, I would think his law firm would be aware of any adopted children as they would have handled the court proceedings.  So that leaves natural children.  Now Daddy was a gadfly at certain points in his life and there could be children whom he had no idea he had. But before I talk about that, let me talk about the will itself.  There were basically two parts to the will.  The first part was the specific bequest. Evidently, he set up five different trust which were to be distributed within 6 months of his death. There was one for Catherine Louise Porter, one for Elizabeth Maxine Porter, one for David Melvin Watters, one for Mary Southerland, and one for an unknown person -child of Mary Southerland and Melvin Porter other than Elizabeth Maxine Porter. From the schedule of distribution which was distributed the year he died, the Mary Southerland and the child of Mary Southerland trust were not distributed. They remain whole and intact.  They have probably grown since 2002.  All the rest was distributed.  The second part deals with the residual of the estate.  The residual is to be distributed to Melvin’s children natural or adopted to share and share alike. This distribution is to take place within 6 months of the 18th anniversary of his death. This is the final distribution whereby all assets will end up in the hands of the legatees. Should any legatee described in the will, be deceased or not be able to located or identified and has not made a claim by August 31, 2019, then their share will go to their descendants both natural and adopted. Those descendants must submit a claim no later than August 31, 2019. Should no claim be made at that point, the unclaimed share shall be equally divided among the remainder of my children or their descendants which have been identified and made a claim. He then lists his children:  Catherine Louise Porter, Elizabeth Maxine Porter, Unknown Southerland. He then makes a special bequest: any amounts scheduled to be distributed in the final distribution to Elizabeth Maxine Porter shall be divided and distributed 50% to Elizabeth Maxine Porter and 50% to Christina Mallory Kennard.  Should either be deceased, then their share will be distributed to their descendants whether natural or adopted. If Christina Mallory Kennard be deceased and she has no living descendants at the date of distribution, then her share will be distributed to Elizabeth Maxine Porter and/or her descendants.

    1. Collins,
Isn’t that the way life is? Lots of things going on which requires multi-tasking? My Bette and Tina are on the same page… they have been working at it for more than 20 years. They know what irritates and what soothes the other. They know they have responsibilities for their children. And most of all, they love their choices they have made in life – each other as partners, their professions, and their role as parents. This is a summer of change for these two. New professions, new home and a some what different family structure. The transition from their New York life to a life in California is full and getting Angie ready for Yale is thrown into the mix. Time is limited and what needs to be accomplished is much. And these two women will get it done…

      Thank you for reading.
