    The Conversion

Sometime that week, I heard from my lawyer, Janice Baldwin. She told me that my contract was based on a book-by-book basis. They were entitled to all the publication rights of any book for which they had accepted to publish. They were to get the first right of refusal on any future book that I would publish for the next three years. At that point, that right would expire and I would be free to seek another publisher with any future work. All books they had contracted to publish would remain their property. The contract was silent with respect to collaborative works. For every book they accepted the publishing rights for, they would provide me an advance on my share of the profits on the sale of the book. Expenses to market the book would be split 50/50. Any books they rejected I was free to seek other publishers to get my book published.

Tina: Since the contract is silent with respect to collaborative works with another author, does that mean it simply is not a part of the agreement?

Janice:  That is my opinion. Since it is not specified, then I would say that it is not covered. You see, they have a contract with you. They have no contract with your collaborator, so they cannot force the collaborator to sell their rights to publication without their agreement. But they can with you as a solo author force you to offer anything you write the right to accept or refuse publication rights.  At least for the next three years.  Now, I assume that you have not started your collaborative process?

    Tina:  No, I have not.

Janice: Well, I would recommend that you have a contract to define what your relationship will be. You need to define your ownership percentage, your rights to the profits and your obligations toward the expenses. And it important that you agree on how decisions will be made such as choice of publisher or marketing techniques. You probably need to limit how much personal capital you will put into the project before you shut it down. And lastly you need to define how you will dissolve the partnership as in what would cause a dissolution.  You are in essence forming a business partnership and you need to define what your relationship will be.  And it’s best to do that on the front end before you have something of value or before you start to put resources into it.

      • Janice24,

First of all this story is an alternative time and life for our Bette and Tina. The story is being told by a woman who is older (85 years old) and has experienced a full and joyful life with the woman she loved. They have had more than 40 years together even though they didn’t meet until they were middled aged. I like that they took the time to get to know one another for a few days before charging into a romantic relationship. I like that Bette insist that Tina think about her own life and if she is prepared for the changes which will occur as they start to see each other romantically. Bette wants Tina to make her decision about her life knowing the possible downside. For me, that shows immediately how much Bette respects and cares for Tina right out of starting gates. I also like that Bette insist they talk about things fully as they go. She seeks out Tina’s boundaries and comfort level before they do anything. This is why their relationship is so strong…. they hide nothing from each other.

From the idea to publication, I took 4 days… I enjoyed writing this story because I could see that both Bette and Tina would go from a mundane life to a life of love and devotion within a matter of weeks. And it would result in a lifetime of happiness. Isn’t that what we all want in our lives?

Thank for reading and for commenting on this story… until I saw your comments, I didn’t think anyone had read it…. Thank you for your support and encouragement…

      • OneStorm1 – Thank you for reading… I published this a little more than a year ago and I posted it this year on Achieve of Our Own. I do have three long book stories which is a single series and one other one shot which is about the same length as this one. I then not to writer about angst and problems between Bette and Tina. I think there are plenty of authors who present those kind of stories. All my published stories are on this website. Go to the story search page, put my name in under author (Martha3128) and they are all listed.
